These Terms of Service ("Terms") govern your use of the website at paintsoilwatertesting.com and the inspection and testing services provided by Paint, Soil & Water Testing Company, LLC ("we," "us," or "our"). By using our website or engaging us to perform services, you agree to these Terms.

Services we offer

We provide:

  • Lead paint risk assessments (Ohio Licensed Lead Risk Assessor services)
  • Soil testing for heavy metals and other contaminants
  • Water testing
  • Combined and complete environmental testing packages

All inspection services are performed by Ohio-licensed personnel in accordance with applicable EPA, HUD, and Ohio Revised Code requirements (including ORC 3742.35 and 3742.36).

Booking, payment, and cancellation

  • Inspections are scheduled through Calendly. Booking confirms a time slot but is not a final commitment until a deposit or invoice has been issued and acknowledged.
  • We invoice through QuickBooks Online. Payment terms are stated on each invoice. Default terms are "Due on receipt" unless otherwise agreed.
  • Cancellations made at least 48 hours before a scheduled inspection can be rescheduled at no charge. Late cancellations or no-shows may be subject to a fee.
  • Travel surcharges, return-trip fees, and additional unit fees may apply and will be disclosed before work begins.

Customer responsibilities

  • Provide accurate information about the property, including year of construction, total number of units, occupancy status, and any known prior testing or remediation
  • Provide reasonable access to all areas to be inspected at the scheduled time
  • Disclose any safety hazards on the property (aggressive animals, structural issues, hazardous materials beyond lead paint) before our arrival
  • Pay invoices in accordance with the agreed terms

What our reports represent

  • Reports describe the conditions present at the time and date of the inspection. We do not warrant the condition of the property at any other time.
  • Reports are prepared for the property owner or other authorized client identified at booking. We will not release reports to third parties without authorization, except as required by law or regulatory filing.
  • Lead Safe Assessment certifications are valid for the duration specified by the City of Cleveland or other applicable authority.

Intellectual property

The content of paintsoilwatertesting.com (text, images, design) and our inspection report templates and certifications are owned by Paint, Soil & Water Testing Company, LLC. Customers receive a license to use their own inspection reports for the purposes for which they were prepared. You may not redistribute or commercially exploit our reports or website content without permission.

Use of our website

You agree not to:

  • Attempt to gain unauthorized access to any systems or accounts
  • Interfere with the operation of the website
  • Use the site to transmit unlawful, harmful, or fraudulent content
  • Scrape or harvest information from the site for commercial purposes without permission

We reserve the right to suspend or terminate access to our website or services for users who violate these Terms.

Disclaimers and limitation of liability

Our services are performed with the professional care and skill expected of a licensed Lead Risk Assessor in Ohio. To the fullest extent allowed by law:

  • We make no warranties or representations beyond those required by Ohio licensure
  • Inspection reports are based on conditions observed at the inspection. We are not responsible for changes to the property after the inspection.
  • Our total liability for any claim related to our services is limited to the amount you paid us for the specific inspection that gave rise to the claim
  • We are not liable for indirect, incidental, consequential, or punitive damages

This limitation does not apply to liability that cannot be limited under Ohio law (including liability for fraud, willful misconduct, or as required by Ohio Revised Code provisions governing licensed lead risk assessors).

Privacy

Use of your information is governed by our Privacy Policy.

Governing law and disputes

These Terms are governed by the laws of the State of Ohio. Any dispute arising from these Terms or our services will be brought in the state or federal courts located in Cuyahoga County, Ohio.

Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent change. Continued use of our website or services after a change constitutes acceptance of the updated Terms.
